These Terms of Use (“Terms”) govern your access to and use of the website www.selfdrivecarrentalgoa.in (the “Website”) operated under the brand name Rentiago (“Rentiago”, “we”, “us”, or “our”). By accessing, browsing, or using the Website in any manner, you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Website.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and do not require any physical or digital signature.

1. Definitions

• “Rentiago” refers to the intermediary platform operating the Website that connects Users with independent car rental providers in Goa.
• “Service Provider” means any independent, third-party self-drive car rental operator, dealer, or vendor whose contact details may be shared with you through the Website.
• “Services” means the referral and information services provided by Rentiago, namely connecting Users with Service Providers.
• “Rental Arrangement” means any booking, contract, transaction, or agreement entered into directly between a User and a Service Provider.
• “Content” means all text, images, graphics, logos, and other material displayed on the Website.

2. Acceptance and Amendment of Terms

By using the Website, you confirm that you accept these Terms and agree to comply with them. We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting on this page with an updated “Last Updated” date. Your continued use of the Website after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

3. Nature of Service & Intermediary Role (Important Disclaimer)

Rentiago acts solely as an intermediary and referral platform that connects customers with independent Service Providers. Rentiago is an “intermediary” within the meaning of Section 2(1)(w) of the Information Technology Act, 2000.

• Rentiago does not own, operate, manage, lease, control, or directly offer any rental vehicles.
• Rentiago is not a party to any Rental Arrangement between you and a Service Provider.
• All vehicles, pricing, availability, terms, conditions, insurance, security deposits, fuel policies, and conditions of service are determined entirely and exclusively by the Service Provider.
• The display of any Service Provider or vehicle information on the Website does not constitute an offer, endorsement, warranty, or recommendation by Rentiago.

4. No Payment Handling

Rentiago does not collect, process, or handle any payments from Users for car rental services. We only provide the contact details of relevant Service Providers based on your request. Any negotiation, agreement, booking amount, security deposit, or payment is made directly between you and the Service Provider. Rentiago has no visibility into, control over, or responsibility for any financial transaction between you and a Service Provider.

5. Eligibility

To use our Services and to enter into any Rental Arrangement, you represent and warrant that:

• You are at least 18 years of age and are competent to contract under the Indian Contract Act, 1872;
• You hold a valid driving licence recognised under the Motor Vehicles Act, 1988 (or, for foreign nationals, a valid International Driving Permit together with your national licence and passport);
• You possess all documentation required by the Service Provider; and
• You will provide accurate, current, and complete information when using the Website.

6. Booking & Referral Process

• You may submit your requirements (such as dates, vehicle type, and location) through the Website, by phone, or via WhatsApp.
• We will share the contact details of one or more relevant Service Providers with you.
• Rentiago does not guarantee that any Service Provider will accept, confirm, or fulfil your request, nor that a vehicle of your preference will be available.
• It is entirely your choice and responsibility whether or not to engage with any Service Provider after receiving their details.
• We recommend that you independently verify the vehicle, documents, pricing, insurance, and rental terms directly with the Service Provider before making any commitment.

7. User Responsibilities & Obligations

When dealing with a Service Provider, you are solely responsible for:

• Inspecting the vehicle and verifying its condition, documents, insurance, and roadworthiness before accepting it;
• Complying with all applicable traffic laws, the Motor Vehicles Act, 1988, and rules of the road in Goa and India;
• Driving safely, lawfully, and not under the influence of alcohol or any intoxicating substance;
• Paying all fines, penalties, tolls, and challans incurred during the rental period;
• Returning the vehicle in the agreed condition and adhering to the Service Provider’s fuel, mileage, and return-time policies; and
• Bearing all costs arising from any damage, loss, theft, or accident during the Rental Arrangement, as agreed with the Service Provider.

8. Cancellations, Refunds & Disputes

Since Rentiago does not handle bookings or payments, all cancellation, refund, and rescheduling policies are governed solely by the terms of the relevant Service Provider. Any dispute, claim, complaint, or disagreement regarding a vehicle, service quality, pricing, refund, damage, or conduct is strictly a matter between you and the Service Provider. Rentiago is not a party to, and bears no responsibility for the resolution of, any such dispute. However, as a goodwill gesture, you may notify us of any grievance and we may, at our sole discretion, attempt to facilitate communication.

9. Prohibited Use of the Website

You agree that you will not:

• Use the Website for any fraudulent, unlawful, misleading, or malicious purpose;
• Impersonate any person or entity or misrepresent your identity or affiliation;
• Upload or transmit viruses, malware, or any harmful code;
• Attempt to gain unauthorised access to the Website, its servers, or any connected systems;
• Copy, reproduce, scrape, or exploit any Content without our prior written consent; or
• Use the Website in any manner that violates applicable Indian law, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

10. Intellectual Property Rights

All Content on the Website, including the Rentiago name, logo, text, graphics, layout, and design, is the property of Rentiago or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not use, reproduce, distribute, or create derivative works from any Content without our prior written permission. Vehicle brand names and logos belong to their respective owners and are used for identification purposes only.

11. Third-Party Content & Links

The Website may contain links to third-party websites or resources, including those of Service Providers, provided solely for your convenience. Rentiago has no control over, and assumes no responsibility for, the content, privacy policies, accuracy, or practices of any third-party websites. Accessing such links is at your own risk.

12. Disclaimer of Warranties

The Website and Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Rentiago disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Rentiago does not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses, or that any Service Provider’s vehicle or service will meet your expectations.

13. Limitation of Liability

To the maximum extent permitted under applicable law, Rentiago, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

• Your dealings, communications, or Rental Arrangements with any Service Provider;
• The quality, safety, legality, condition, or availability of any vehicle or service provided by a Service Provider;
• Any delay, cancellation, breakdown, accident, injury, damage, loss, or theft; or
• Your use of, or inability to use, the Website.

All risks related to any Rental Arrangement remain solely between you and the Service Provider. Where liability cannot be excluded by law, our total aggregate liability shall not exceed INR 1,000 (Indian Rupees One Thousand only).

14. Indemnification

You agree to indemnify, defend, and hold harmless Rentiago and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Website, your breach of these Terms, your violation of any law, or any Rental Arrangement you enter into with a Service Provider.

15. Privacy & Data Protection

Any personal information you provide is collected, used, and protected in accordance with our Privacy Policy and applicable law, including the Digital Personal Data Protection Act, 2023. By using our Services, you consent to us sharing your contact details with relevant Service Providers for the purpose of facilitating your rental request.

16. Force Majeure

Rentiago shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, monsoon conditions, pandemics, government actions, strikes, civil unrest, power or internet failures, or any other force majeure event.

17. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. No waiver by Rentiago of any term shall be deemed a further or continuing waiver of such term or any other term.

18. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to the dispute resolution clause below, you and Rentiago agree that the courts at Vasco-da-Gama, in the State of Goa, India, shall have sole and exclusive jurisdiction over any litigation arising from or relating to these Terms.

19. Dispute Resolution & Arbitration

In the event of any dispute arising between you and Rentiago in relation to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Goa, India, and the proceedings shall be conducted in English.

20. Grievance Redressal

In accordance with the Information Technology Act, 2000, the rules made thereunder, and the Consumer Protection Act, 2019, any grievances regarding the Website may be directed to our Grievance Officer:

We endeavour to acknowledge grievances within 48 hours and to resolve them within a reasonable time frame as prescribed by law.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rentiago regarding your use of the Website and supersede any prior agreements or understandings.
